HOLOMATIX DOWNLOADED SOFTWARE LICENSE AGREEMENT

By downloading software of Holomatix Ltd from this site, you agree to the following terms and conditions. If you do not agree with such terms and conditions do not download the software. Please click the box marked 'I agree' to confim your agreement with this terms.

Holomatix grants you a non-exclusive license for use of the software that you are about to download. The license limits the use of the software to you only. The software is licensed, not sold. You may not distribute or forward the software to any other party without the express written permission of Holomatix Ltd.

You are hereby licensed to use the software for evaluation purposes only. Use of the software for any commercial or non-evaluation purpose requires express written permission from Holomatix Ltd. You agree to discontinue use of the software immediately if so requested by Holomatix Ltd.

You are specifically prohibited from: making copies if the software; distributing to any other party copies of the software; charging or requesting donations, monies or rewards of any kind for any such copies, however made, and from distributing the software with other products commercial or otherwise without prior written permission; disassembling, decompiling, reverse engineering, modifying, translating or creating derivative works based on the software; leasing, selling or renting the software; removing any proprietary notices, labels, legends or logos from the software; embedding the software as part of any other products commercial or otherwise;

DISCLAIMER OF WARRANTIES: YOU AGREE THAT HOLOMATIX HAS MADE NO EXPRESS WARRANTIES TO YOU REGARDING THE SOFTWARE AND THAT THE SOFTWARE IS BEING PROVIDED TO YOU "AS IS" WITHOUT WARRANTY OF ANY KIND. HOLOMATIX DISCLAIMS ALL WARRANTIES WITH REGARD TO THE SOFTWARE, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, MERCHANTABLE QUALITY, OR NONINFRINGEMENT OF THIRD-PARTY RIGHTS.

LIMIT OF LIABILITY: IN NO EVENT WILL HOLOMATIX BE LIABLE TO YOU FOR ANY LOSS OF USE, INTERRUPTION OF BUSINESS, OR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND (INCLUDING LOST PROFITS) REGARDLESS OF THE FORM OF ACTION WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT PRODUCT LIABILITY OR OTHERWISE, EVEN IF HOLOMATIX HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
